In the European Union, the General Data Protection Regulation (GDPR) provides comprehensive rules for the processing of personal data. In addition, the EU lawmaker intends to adopt specific rules to protect confidentiality of communications, in a separate ePrivacy Regulation. Some have argued that there is no need for such additional rules for communications confidentiality. This Article discusses the protection of the right to confidentiality of communications in Europe. We look at the right’s origins to assess the rationale for protecting it. (...) We also analyze how the right is currently protected under the European Convention on Human Rights and under EU law. We show that at its core the right to communications confidentiality protects three individual and collective values: privacy, freedom of expression, and trust in communication services. The right aims to ensure that individuals and organizations can safely entrust communication to service providers. Initially, the right protected only postal letters, but it has gradually developed into a strong safeguard for the protection of confidentiality of communications, regardless of the technology used. Hence, the right does not merely serve individual privacy interests, but also other more collective interests that are crucial for the functioning of our information society. We conclude that separate EU rules to protect communications confidentiality, next to the GDPR, are justified and necessary. (shrink)

Atualmente, os formuladores de políticas vêm se aprofundando na ideia de consentimento informado como um meio para proteger a privacidade. Por exemplo, em diversos países, as empresas são obrigadas por lei a obter o consentimento de um indivíduo antes de fazer uso dos seus dados; com base nessas requisitos de consentimento informado, a lei tem por objetivo empoderar as pessoas a fazerem escolhas de privacidade tendo em vista os (...) seus melhores interesses. No entanto, estudos comportamentais colocam em cheque a eficácia desta abordagem de empoderamento como um meio para proteger a privacidade. Este artigo defende uma abordagem conjunta de proteção e empoderamento dos indivíduos para aprimorar a proteção da privacidade. Este artigo aborda problemas práticos do consentimento informado como um meio para proteger a privacidade, e ilustra problemas com os atuais regulamentos de proteção à privacidade dos dados, concernentes à segmentação comportamental. Primeiramente, discutem-se os problemas de privacidade relativos à segmentação comportamental, e o papel central do consentimento informado ao abrigo da lei de proteção à privacidade. Em seguida, enfatizam-se os problemas práticos referentes ao consentimento informado. Por fim, o artigo argumenta que os formuladores de políticas devem dar mais atenção aos regulamentos que protegem as pessoas, e menos aos que as empoderam. But behavioural studies cast doubt on this approach’s effectiveness, as people tend to click OK to almost any request they see on their screens. The aim of this paper is threefold. Firstly, §1 and §2 introduce the novel concept logical akrasia by analogy to epistemic akrasia. If successful, the initial sections will draw attention to an interesting akratic phenomenon which has not received much attention in the literature on akrasia (although it has been discussed by logicians in different terms). Secondly, §3 and §4 present a dilemma related to logical akrasia. From a case involving the consistency of Peano Arithmetic and Gödel’s Second Incompleteness Theorem (...) it’s shown that either we must be agnostic about the consistency of Peano Arithmetic or akratic in our arithmetical theorizing. If successful, these sections will underscore the pertinence and persistence of akrasia in arithmetic (by appeal to Gödel’s seminal work). Thirdly, §5 concludes by suggesting a way of translating the dilemma of arithmetical akrasia into a case of regular epistemic akrasia; and further how one might try to escape the dilemma when it’s framed this way. A key question in the philosophy of logic is how we have epistemic justification for claims about logical entailment (assuming we have such justification at all). Justification holism asserts that claims of logical entailment can only be justified in the context of an entire logical theory, e.g., classical, intuitionistic, paraconsistent, paracomplete etc. According to holism, claims of logical entailment cannot be atomistically justified as isolated statements, independently of theory choice. At present there is a developing interest in—and endorsement of—justification holism (...) due to the revival of an abductivist approach to the epistemology of logic. This paper presents an argument against holism by establishing a foundational entailment-sentence of deduction which is justified independently of theory choice and outside the context of a whole logical theory. Default logic has been a very active research topic in artificial intelligence since the early 1980s, but has not received as much attention in the philosophical literature thus far. This paper shows one way in which the technical tools of artificial intelligence can be applied in contemporary epistemology by modeling a paradigmatic case of deep disagreement using default logic. In §1 model-building viewed as a kind of philosophical progress is briefly motivated, while §2 introduces the case of deep disagreement we (...) aim to model. This paper aims to show that Selim Berker’s widely discussed prime number case is merely an instance of the well-known generality problem for process reliabilism and thus arguably not as interesting a case as one might have thought. Initially, Berker’s case is introduced and interpreted. Then the most recent response to the case from the literature is presented. Eventually, it is argued that Berker’s case is nothing but a straightforward consequence of the generality problem, i.e., the problematic aspect of the (...) case for process reliabilism (if any) is already captured by the generality problem. Denne korte artikel vil give en approksimation af, hvad der forstås ved konsekventialisme på et generisk niveau. Målet med artiklen er at klargøre nogle af de grundantagelser og distinktioner, som konsekventialister ofte benytter i deres teoridannelse, og som bør holdes for øje i ønsket om en frugtbar debat.

While the epistemic significance of disagreement has been a popular topic in epistemology for at least a decade, little attention has been paid to logical disagreement. This monograph is meant as a remedy. The text starts with an extensive literature review of the epistemology of (peer) disagreement and sets the stage for an epistemological study of logical disagreement. The guiding thread for the rest of the work is then three distinct readings of the ambiguous term ‘logical disagreement’. Chapters 1 and (...) 2 focus on the Ad Hoc Reading according to which logical disagreements occur when two subjects take incompatible doxastic attitudes toward a specific proposition in or about logic. Chapter 2 presents a new counterexample to the widely discussed Uniqueness Thesis. Chapters 3 and 4 focus on the Theory Choice Reading of ‘logical disagreement’. According to this interpretation, logical disagreements occur at the level of entire logical theories rather than individual entailment-claims. Chapter 4 concerns a key question from the philosophy of logic, viz., how we have epistemic justification for claims about logical consequence. In Chapters 5 and 6 we turn to the Akrasia Reading. On this reading, logical disagreements occur when there is a mismatch between the deductive strength of one’s background logic and the logical theory one prefers (officially). Chapter 6 introduces logical akrasia by analogy to epistemic akrasia and presents a novel dilemma. Chapter 7 revisits the epistemology of peer disagreement and argues that the epistemic significance of central principles from the literature are at best deflated in the context of logical disagreement. The chapter also develops a simple formal model of deep disagreement in Default Logic, relating this to our general discussion of logical disagreement. This paper sketches a general account of how to respond in an epistemically rational way to moral disagreement. Roughly, the account states that when two parties, A and B, disagree as to whether p, A says p while B says not-p, this is higher-order evidence that A has made a cognitive error on the first-order level of reasoning in coming to believe that p. If such higher-order evidence is not defeated, then one rationally ought to reduce one’s confidence with respect (...) to the proposition in question. We term this the higher-order evidence account, and present it as a superior to what we might call standard conciliationism, which holds that when agents A and B disagree about p, and are epistemic peers, they should both suspend judgement about p or adjust their confidence towards the mean of A and B’s prior credences in p. Many have suspected that standard conciliationism is implausible and may have skeptical implications. After presenting the HOE account, we put it to work by applying it to a range of cases of moral disagreement, including those that have feature in recent debates assuming standard conciliationism. We show that the HOE account support reasonable, non-skeptical verdicts in a range of cases. Cycling in traffic requires a combination of motor and perceptual skills while interacting with a dynamic and fast-changing environment. The inferior perceptual-motor skills in individuals with developmental coordination disorder may put them at a higher risk for accidents. A key skill to navigate in traffic is to quickly detect hazardous situations. This perceptual-cognitive skill was investigated in young adults with DCD using simulated traffic situations in a hazard perception test in cycling. Nine individuals with DCD and nine typically developing individuals (...) participated in the study and completed the test while their gaze was tracked using a remote eye tracking device. A questionnaire was used to determine cycling experience and the perception of cycling and anticipation skill in traffic. Despite a longer period to master the motor skill of cycling, individuals with DCD reported to be able to safely cycle in traffic around the same age as TD young adults. In the hazard perception test, individuals with DCD fixated the hazards later, less frequently and for a shorter duration than the TD participants, however, the participants with DCD did not wait longer to react to the hazard than the TD participants. Interestingly, individuals with DCD rated the traffic situations in the test as significantly more dangerous than the TD participants. In conclusion, the differences exposed in the hazard perception test may imply an increased risk of accidents in individuals with DCD. In further research and practice it is recommended that both the motor and the perceptual aspects of cycling are addressed. (shrink)

AimThe neurocognitive basis of Developmental Coordination Disorder remains an issue of continued debate. This combined systematic review and meta-analysis provides a synthesis of recent experimental studies on the motor control, cognitive, and neural underpinnings of DCD.MethodsThe review included all published work conducted since September 2016 and up to April 2021. One-hundred papers with a DCD-Control comparison were included, with 1,374 effect sizes entered into a multi-level meta-analysis.ResultsThe most profound deficits were shown in: voluntary gaze control during movement; cognitive-motor integration; practice-/context-dependent (...) motor learning; internal modeling; more variable movement kinematics/kinetics; larger safety margins when locomoting, and atypical neural structure and function across sensori-motor and prefrontal regions.InterpretationTaken together, these results on DCD suggest fundamental deficits in visual-motor mapping and cognitive-motor integration, and abnormal maturation of motor networks, but also areas of pragmatic compensation for motor control deficits. Artifacts are probably our most obvious everyday encounter with technology. Therefore, a good understanding of the nature of technical artifacts is a relevant part of technological literacy. In this article we draw from the philosophy of technology to develop a conceptualization of technical artifacts that can be used for educational purposes. Furthermore we report a small exploratory empirical study to see to what extent teachers’ intuitive ideas about artifacts match with the way philosophers write about the nature of artifacts. Background As our society is ageing, nursing homes are finding it increasingly difficult to deal with an expanding population of patients with dementia and a decreasing workforce. A potential answer to this problem might lie in the use of technology. However, the use and application of surveillance technology in dementia care has led to considerable ethical debate among healthcare professionals and ethicists, with no clear consensus to date. Aim To explore how surveillance technology is viewed by care professionals and ethicists (...) working in the field, by investigating the ideal application of surveillance technology in the residential care of people with dementia. Methods Use was made of the concept mapping method, a computer-assisted procedure consisting of five steps: brainstorming, prioritising, clustering, processing by the computer and analysis. Various participants (ranging from ethicists to physicians and nurses) were invited on the basis of their professional background. Results The views generated are grouped into six categories ranging from the need for a right balance between freedom and security, to be beneficial and tailored to the resident, and clearly defined procedures to competent and caring personnel, active monitoring and clear normative guidance. The results are presented in the form of a graphic chart. Conclusions There appears to be an inherent duality in the views on using surveillance technology which is rooted in the moral conflict between safety and freedom. Elaboration of this ethical issue has proved to be very difficult. (shrink)

Background:Surveillance technology such as tag and tracking systems and video surveillance could increase the freedom of movement and consequently autonomy of clients in long-term residential care settings, but is also perceived as an intrusion on autonomy including privacy.Objective:To explore how clients in residential care experience surveillance technology in order to assess how surveillance technology might influence autonomy.Setting:Two long-term residential care facilities: a nursing home for people with dementia and a care facility for people with intellectual disabilities.Methods:Ethnographic field study.Ethical considerations:The boards (...) representing clients and relatives/proxies of the clients were informed of the study and gave their written consent. The clients’ assent was sought through a special information leaflet. At any time clients and/or proxy were given the option to withdraw from the study. The research protocol was also reviewed by a medical ethics committee.Findings:Our findings show a pattern of two themes: (1) coping with new spaces which entailed clients: wandering around, getting lost, being triggered, and retreating to new spaces and (2) resisting the surveillance technology measure because clients feel stigmatized, missed the company, and do not like being “watched.”Conclusion:Client experiences of surveillance technology appear to entail a certain ambivalence. This is in part due to the variety in surveillance technology devices, with each device bringing its own connotations and experiences. But it also lies in the devices’ presupposition of an ideal user, which is at odds with the actual user who is inherently vulnerable. Surveillance technology can contribute to the autonomy of clients in long-term care, but only if it is set in a truly person-centered approach. (shrink)

This kind of general trend has hardly left the thinking in the field of music and music education untouched. Inspiration comes from the technical rationality of our time. This rationality affects an oblivion of ontology. In this article we discuss this trend related to Martin Heidegger’s thinking concerning the human existence in the world, artworks and notions (...) like “being” (Sein) and “oblivion-of-being” (Seinsvergessenheit). We think that it is possible to see this “oblivion-of-being” in relation to the trend in cultural and educational politics as well as in music educational thinking to focus on the instrumental usefulness of learning music. Among all organisms, the size of each body part or organ scales with overall body size, a phenomenon called allometry. The study of shape and form has attracted enormous interest from biologists, but the genetic, developmental and physiological mechanisms that control allometry and the proportional growth of parts have remained elusive. Recent progress in our understanding of body‐size regulation provides a new synthetic framework for thinking about the mechanisms and the evolution of allometric scaling. In particular, insulin/IGF signaling, which plays (...) major roles in longevity, diabetes and the regulation of cell, organ and body size, might also be centrally involved in regulating organismal shape. Here we review recent advances in the fields of growth regulation and endocrinology and use them to construct a developmental model of static allometry expression in insects. This model serves as the foundation for a research program that will result in a deeper understanding of the relationship between growth and form, a question that has fascinated biologists for centuries. The defence of The No Alternatives Argument in a recent paper by R. Dawid, S. Hartmann and J. Sprenger rests on the assumption that the number of acceptable alternatives to a scientific hypothesis is independent of the complexity of the scientific problem. This note proves a generalisation of the main theorem by Dawid, Hartmann and Sprenger, where this independence assumption is no longer necessary. Some of the other assumptions are also discussed, and the limitations of the no-alternatives argument are explored.

A basic form of iconicity in literature is the correspondence between basic conceptual schemata in literary semantics on the one hand and in factual treatments on the other. The semantics of a subject like espionage is argued to be dependent on the ontology of the field in question, with reference to the English philosopher Barry Smith’s “fallibilistic apriorism”. This article outlines such an ontology, on the basis of A. J. Greimas’s semiotics and Carl Schmitt’s philosophy of state, claiming that the (...) semantics of espionage involves politology and narratology on an equal footing. The spy’s “positional” character is analyzed on this basis. A structural difference between police and military espionage is outlined with reference to Georges Dumézil’s theory of the three functions in Indo-European thought. A number of ontological socalled “insecurities” inherent in espionage and its literary representation are outlined. Finally, some hypotheses are stated concerning the connection between espionage and literature, and some central allegorical objects — love, theology — of the spy novel are sketched, and a conclusion on the iconicity of literature is made. Art and philosophy are the modes (...) of practice that disrupt and disorganize our habitual ways of doing things, everything from dancing to language, to philosophy and art themselves. They are the reflection at a distance of what we do. “In this sense, then, art is disruptive. Always: everywhere.” From this basis, he tackles a wide range of phenomena from dancing, seeing, writing, and so forth, to introduce a distinction between these as everyday phenomena and their function as art. This delimitation is not material, nor intrinsic to any of the analyzed phenomena; rather, it depends on each practice’s ability to disrupt, disorganize, and force upon us the question of what dancing, seeing, writing is at all. Noë provides an example: At an art exhibition one is confronted with a painting that is ungraspable, foreign, meaningless. But, through a mediation (pointers from a friend, new knowledge of the era, analyses of the style, and so forth) the painting starts becoming significant; it starts to make sense. The viewer is stopped in her tracks, and a painting that was before closed is now opened up to a new perception, a new way of seeing.But Noë extends this aesthetic domain to experience and perception. In perception, we are actively engaged in achieving the things around us, achieving the world. And, in art, this habitual way of attainment is obstructed, for art presents us with new ways of seeing, listening, feeling, and so forth. Noë thus challenges common (especially neuro-aesthetic) views on perception and experience in favor of a more phenomenological approach by which he accentuates the active engagement in the world by which perception and experience come about. And this aesthetic domain, broadly understood, is the locus of showing how we, through these disruptive practices, create new ways of doing, perceiving, understanding, and, even further, create ourselves. We “all operate in a space of significance held open by art.” In other words, it is through a reassessment of the aesthetic that Noë shows how art and philosophy make us what we are. For what we are, for Noë, is this ability of disruption, development, and creation of ourselves. This is what makes us human. Human nature is therefore essentially cultural, a disruption of habit and new avenues of development, but one that is rooted in our body as a horizon of possibilities. Buytendijk (1887–1974) entwickelte in seinen Forschungen der 1920er und 1930er Jahre in Abgrenzung zum Behaviorismus eine antireduktionistische Zugangsweise auf Verhaltensexperimente. So bezog er in seinen Experimentalpraktiken explizit die subjektive Erfahrung des Versuchsleiters mit ein. Damit entwarf Buytendijk eine Wissenschaftstheorie, die methodologisch auf die Phänomenologie, Hermeneutik wie auf gestalttheoretische Ganzheitskonzepte zurückgriff, quantitative Datenerhebungen aber dennoch nicht aufgab. Vielmehr untersuchte Buytendijk auf der Grundlage des Biotheoretikers Jakob von Uexküll (1864–1944) in seinem physiologischen Institut in Groningen (...) konkret die These einer „Tier-Umwelt-Einheit“. Der vorliegende Beitrag ermittelt anhand der institutionellen Rahmenbedingungen und zweier Experimente (1924 und 1931), inwiefern Buytendijk seine Aussage, dass das Tier „mit und in seiner Umwelt geboren [ist]“, die zugleich sein wissenschaftsphilosophisches Konzept stützte, zu verifizieren wusste. We study a logic for deontic necessity and sufficiency, as originally proposed in van Benthem :36–41, 1979). Building on earlier work in modal logic, we provide a sound and complete axiomatization for it, consider some standard extensions, and study other important properties. After that, we compare this logic to the logic of “obligation as weakest permission” from Anglberger et al. :807–827, 2015).

Recent studies on mind‐wandering reveal its potential role in goal exploration and planning future actions. How to understand these explorative functions and their impact on planning remains unclear. Given certain conceptions of intentions and beliefs, the explorative functions of mind‐wandering could lead to regular reconsideration of one's intentions. However, this would be in tension with the stability of intentions central to rational planning agency. We analyze the potential issue of excessive reconsideration caused by mind‐wandering. We propose simple nonlinear mathematical models for the legal concept of balancing of interests. Our aim is to bridge the gap between an abstract formalisation of a balancing decision while assuring consistency and ultimately legal certainty across cases. We focus on the conflict between the rights to privacy and to the protection of personal data in Art. 7 and Art. 8 of the EU Charter of Fundamental Rights (EUCh) against the right of access to information derived from Art. 11 EUCh. (...) These competing rights are denoted by ( \(i_1\) ) _right to privacy _ and ( \(i_2\) ) _access to information_; mathematically, their indices are respectively assigned by \(u_1\in [0,1]\) and \(u_2\in [0,1]\) subject to the constraint \(u_1+u_2=1\). This constraint allows us to use one single index _u_ to resolve the conflict through balancing. The outcome will be concluded by comparing the index _u_ with a prior given threshold \(u_0\). For simplicity, we assume that the balancing depends on only selected legal criteria such as the social status of affected person, and the sphere from which the information originated, which are represented as inputs of the models, called legal parameters. Additionally, we take “time” into consideration as a legal criterion, building on the European Court of Justice’s ruling on the right to be forgotten: by considering time as a legal parameter, we model how the outcome of the balancing changes over the passage of time. To catch the dependence of the outcome _u_ by these criteria as legal parameters, data were created by a fully-qualified lawyer. By comparison to other approaches based on machine learning, especially neural networks, this approach requires significantly less data. This might come at the price of higher abstraction and simplification, but also provides for higher transparency and explainability. Two mathematical models for _u_, a time-independent model and a time-dependent model, are proposed, that are fitted by using the data. (shrink)

Information can be public among a group. Whether or not information is public matters, for example, for accounts of interdependent rational choice, of communication, and of joint intention. A standard analysis of public information identifies it with (some variant of) common belief. The latter notion is stipulatively defined as an infinite conjunction: for p to be commonly believed is for it to believed by all members of a group, for all members to believe that all members believe it, and so (...) forth. This analysis is often presupposed without much argument in philosophy. Theoretical entrenchment or intuitions about cases might give some traction on the question, but give little insight about why the identification holds, if it does. The strategy of this paper is to characterize a practical-normative role for information being public, and show that the only things that play that role are (variants of) common belief as stipulatively characterized. In more detail: a functional role for “taking a proposition for granted” in non-isolated decision making is characterized. I then present some minimal conditions under which such an attitude is correctly held. The key assumption links this attitude to beliefs about what is public. From minimal a priori principles, we can argue that a proposition being public among a group entails common commitment to believe among that group. Later sections explore partial converses to this result, the factivity of publicity and publicity from the perspective of outsiders to the group, and objections to the aprioricity of the result deriving from a posteriori existential presuppositions. The articles discuss why Wittgenstein wrote so intensively about colour during the last years of his life andwhat significance these remarks have for understanding his philosophical work in general.".

Should we regard Jennifer Lackey’s ‘Creationist Teacher’ as understanding evolution, even though she does not, given her religious convictions, believe its central claims? We think this question raises a range of important and unexplored questions about the relationship between understanding, factivity and belief. Our aim will be to diagnose this case in a principled way, and in doing so, to make some progress toward appreciating what objectual understanding—i.e., understanding a subject matter or body of information—demands of us. Here is the (...) plan. After some ground clearing in §1, §2 outlines and motivates a plausible working model—moderate factivity—for characterising the sense in which objectual understanding should be regarded as factive. §3 shows how the datum that we can understand false theories can, despite initial suggestions to the contrary, be assimilated straightforwardly within the moderate factivity model. §4 highlights how the inverse kind of case to that explored in §3—viz., a variant of Lackey’s creationist teacher case—poses special problems for moderate factivity. With reference to recent work on moral understanding by Hills, §5 proposes a solution to the problem, and §6 attempts to diagnose why it is that we might originally have been led to draw the wrong conclusion. Is there a morally relevant difference between a brain‐damaged human being and a nonhuman animal at the same cognitive and emotional level to justify, say, performing medical experiments on the animal but not the human being? Some hold that the misfortune of the human being allows us to distinguish between them. I consider the nature of misfortunate and argue that an appeal to misfortune fails to distinguish between the human being and the nonhuman animal when the treatment at issue is (...) equally morally serious, since the source of the limitation taken advantage of by performing the medical experiment, whether misfortunate or natural vulnerability, is irrelevant.
